A woman caught on video taking her own video and making racist remarks on the MRT train on April 21 was released from remand and is out on bail.

Tan Beow Hiong, 57, also referred to as Beow Tan, was made to attend court on June 18 to face three criminal charges and was remanded at the Institute of Mental Health (IMH) for psychiatric evaluation.

The contents of the IMH report were not revealed in court.

The former property agent returned to court on July 2 with a new lawyer after she was charged last week.

Tan faces two counts of committing an act which she knew would be prejudicial to the maintenance of harmony between different racial groups, and one count of being a public nuisance.

New lawyer

Her new lawyer, Sng Kheng Huat, asked for two weeks' adjournment to go through the prosecution's offer.

He said he might ask for the case to be transferred to the Community Court if the prosecution could state its position on calling for a mandatory treatment order.

A MTO is a sentencing option offered to offenders suffering from mental conditions that contributed to an offence.

Under a MTO, an offender will receive psychiatric treatment in lieu of jail time.

The offender will not have a criminal record.

Tan will return to court on July 30.

The judge warned Tan against committing fresh offences now that she has been released.

For committing acts prejudicial to racial or religious harmony, one can face a jail term of up to three years or a fine, or both.

For being a public nuisance that causes annoyance to the public, one can be jailed for up to three months or fined up to S$2,000, or given both penalties.
