Update (as of May 6, 2345Hrs): Tan Cheng Bock's spokesperson has verified that Goh Meng Seng's "report is correct". He added that he will keep the public informed of further developments.
The last time we heard from 2011 Presidential candidate and former PAP veteran MP Tan Cheng Bock, he held a press conference in April to question the decision that Singapore's Elected Presidency started with Wee Kim Wee and not Ong Teng Cheong.
Okay, just to get you up to pace, in case you don't know why this matters — last September, we learned of a change to presidential elections in Singapore: from now on, if five terms of Elected Presidents go by without any of them coming from a minority race, a closed election would have to be held for the members of that race only.
In other words, when applied to reality, Tan cannot stand in this year's Presidential Election if we start counting from Wee, because this means a closed election must be held for the Malay community.
However, Tan wouldn't have qualified even if the election is not a closed or reserved election.
In fact, Law Minister K Shanmugam said previously too, specifically, that Tan won’t qualify under the new eligibility rules because he wasn’t the top guy at any company that was worth S$500m in shareholders’ equity in value.
Anyway, back to the story about the closed election and how it was decided.
Prime Minister Lee Hsien Loong said he had taken the advice of the Attorney-General's Chambers, who defined the Elected Presidency to have started from Wee — the first man to have held EP powers — as opposed to Ong, the first man to be elected by popular vote as President of Singapore.
Tan goes to court
Now, Tan has announced, via a shared status posted by People's Power Party founder Goh Meng Seng, that he is going to court with his concern:
In case you can't read what it says, here's the reproduced text, corrected for spelling errors:
*From Tan Cheng Bock:*
"Yesterday l filed in High Court my Affidavit to ask AGC why the count of 5 presidential terms starts from P.WKE and not P.OTC.
My lawyers are Tan Rajah and Cheah. Chelva Rajah will lead the team. I have a written submission of UK top constitutional lawyer Lord David Pannick. Once the court accepts my application l will say more in my fb."
Finally! I support Dr Tan's challenge!
This development is interesting, bearing in mind that Tan said back in April at his press conference that he would prefer to pursue this in a more civilised fashion than to go to court.
Tan's public Facebook page has yet to announce anything regarding this.
Mothership.sg has contacted Tan for confirmation about the court filing.
