S'porean man, 37, fined S$6,500 for peeking at teenager performing sex act in Holland Village toilet

He could have been imprisoned for two years.

A 37-year-old man has been fined S$6,500 on Tuesday, May 18 for peeking at a teenager and her boyfriend at a toilet cubicle in Holland Village.

The victim is an 18-year-old teenager who cannot be named due to a gag order.

According to court documents seen by Mothership, the man, whose name is Jotham Lee Jing, had gone to Holland Village at about 11 pm on Aug 28, 2020.

Peeked at couple while they carried out sex act

Close to two hours later at about 12.50 am, he saw the victim and her boyfriend entering the women's toilet, situated at Block 10 Lorong Mambong.

Lee followed the couple as he wanted to peek at what they were doing.

After the couple had entered one of the cubicles, Lee entered a neighbour cubicle and squatted down to peek into the cubicle.

The victim then noticed Lee's handphone with its camera facing her.

She exited the cubicle and knocked on the door of the cubicle Lee was in.

Lee hid in the cubicle for a while before attempting to flee, but he was caught by the victim who grabbed him by the back of his shirt.

Caught and charged in court

The couple asked to check Lee's phone.

Lee refused initially but eventually relented, and passed the couple his phone.

There was no pictures or video of themselves, but the victim requested Lee to reformat his phone as she felt insecure. Lee agreed to do so.

The victim's boyfriend then called the police.

"At that point, the victim was performing a sexual act under circumstances in which she had a reasonable expectation of privacy", the court documents read.

CNA reported that Lee pleaded guilty to one count of intentionally observing the victim doing a private act, without the victim's consent. A second charge is considered in sentencing.

The prosecution had submitted for a fine of at least S$6,000 to S$7,000.

The charge and sentencing position were on the basis that there was a lack of evidence that a recording device had been used.

The Prosecution had accordingly not relied on that as an aggravating factor.

Under Section 377BB of the Penal Code, Lee could have been punished with imprisonment for a term which may extend to two years, or with a fine, or with caning, or with any combination of such punishments.
