Divorced dad in China finds out sons aren't his after 22 years of marriage, sues to recover assets & child support

The son and ex-wife have rejected the paternity test results.

After divorcing his wife of 22 years, a man in China discovered that he was not the biological father of his two sons.

He went to court to seek to nullify the agreement made during separation, which included giving properties to the sons.

He also sought compensation for the child support he paid over the years.

Divorce due to absent ex-wife

Citing Chinese media reports, Sin Chew Daily wrote that the man, surnamed Jiang (transliteration), and his wife got married and had two sons.

In 2023, after 22 years of marriage, the two got divorced.

In the separation agreement, it was agreed that the properties owned by the couple would be divided between the sons, according to a local media report.

Jiang would also provide for the eldest son, including his education and other expenses.

Fight with son led to revelation

In September 2024, the eldest son reached out to Jiang to ask for money.

The two got into an argument, and the eldest son blurted, "You are not my biological father."

Jiang became suspicious and ran a paternity test using a sample he obtained from the eldest son's toothbrush.

The test result stated that he and the eldest son were not biologically related.

The courts later affirmed the results, ruling that Jiang and his two sons were indeed not related by blood.

This was also due to neither the wife nor the two sons agreeing to partake in a DNA test.

Compensation

Jiang then went to court to nullify the separation agreement made with his ex-wife.

He sought to nullify the property asset arrangements and get compensation for the child support he paid over the years.

He also sought compensation for the emotional impact he suffered.

Jiang expressed that he had given too much over the years and commented that no amount of compensation could make up for the 20 years of youth he had lost.

Jiang's defence lawyer said that they have reasons to believe that Jiang's cousin, cousin-in-law and ex-wife had conspired to deceive Jiang of his assets.

Ex-wife rejected paternity test result

During a court hearing, Jiang's eldest son rejected a suggestion to do another paternity test.

The two got into a verbal altercation during the hearing.

Jiang also alleged that the eldest son had hit him in the past.

Jiang's ex-wife similarly rejected the results of the paternity test.

She also denied being disloyal and having any improper relationships during the marriage.
