M'sian man, 39, with HIV, jailed & caned for raping disabled woman, 29, in Johor

The man was ordered by the court to undergo rehabilitation during his time in prison.

A 39-year-old man in Malaysia was sentenced to 10 years in jail and five strokes of the cane for raping a 29-year-old woman who suffers from hearing, speech and learning disabilities.

According to New Straits Times, the offence took place in a house in Johor at around 11:50pm on Jan. 30.

The man, who worked as a security guard, was aware of the woman's physical disabilities at the time of the offence, Bernama wrote.

His defence lawyer, appealing for a lighter sentence, informed the court that the man is HIV positive and suffers from leukaemia which requires ongoing treatment.

The defence lawyer also told the court that the man was remorseful and sought forgiveness.

However, the prosecutor said that this put the victim at risk of contracting the sexually transmitted disease.

"The accused took advantage of a victim with multiple disabilities. Furthermore, the fact that he has HIV means his actions exposed the victim to the risk of infectious venereal diseases," the prosecutor said, according to NST.

The man was also ordered by the court to undergo rehabilitation during his time in prison.
