Man, 67, makes domestic worker, 35, drink wine, gives her 'supplements', rapes her & claims she orchestrated affair
"I came here in this country to work and I suffered this," she said.
When the rest of his family was overseas, a 67-year-old man plied his daughter's domestic worker with wine.
He invited her to watch television with him and offered her "supplement" injections, claiming it would be good for her skin.
She accepted it as she had seen him administer them to his family members.
Soon, she felt dizzy, "as though everything was spinning". She could not control her body but was aware of what was happening around her.
When she told the man she was feeling dizzy, the man replied that it was good as it would be "easier for her to sleep".
He then raped her on the living room sofa.
Man's daughter made police report
The man, who claimed to be previously a "supplement researcher" supplying supplements, was arrested after the victim told her employer, the man's daughter, about the incident.
The employer brought her to make a police report after viewing the living room's CCTV footage.
The man denied all five charges of rape and sexual assault against him, claiming that the victim had orchestrated the affair to extort money from his family.
He was convicted of four charges after a trial.
He cannot be named due to a gag order.
Before the assault
The victim testified that the assault took place on Jan. 5, 2020.
She was 35 years old.
Prosecutors said that the victim's employers had flown to Taiwan to settle the affairs of their late mother, who had just passed away in November 2019, leaving only herself and the man in the unit.
In the evening, the man invited her to watch television.
The victim said he later brought out a bottle of red wine and poured her some.
She was not allowed to drink alcohol but took the wine as she "saw no reason to resist" as the man was her employer's father.
CCTV footage
The living room CCTV footage submitted as evidence showed the victim in a "very weakened and unresponsive state" throughout the assault, according to the prosecution.
The victim said she tried to raise her hands to prevent him from continuing the assault but was unable to stop him.
After raping and sexually assaulting her, the man carried her back to her bedroom and placed her on her bed, as shown in the footage.
"Why did he do this to me?"
Upon her employers' return on Jan. 8, 2o20, the woman reported it to them immediately.
She was brought to lodge a police report the next day.
In her victim statement, the domestic worker said that she had felt "so scared [and] helpless" during the assault.
"I want to shout, but I can't. I want to resist, but I cant.
"I came here in this country to work and I suffered this."
After the assault, she became very affected and unable to focus on her work, she said.
She added that she was very angry at the man — who she called "Kong Kong" ("grandfather" in Chinese).
"Why did he do this to me? After all I've done to his family. I take care of Ah Ma, he knows how I took care of Ah Ma. How I care for the whole family.
And in the end, he had the courage to do this to me."
Man denies assault, claims
Apart from the egregious nature of the assault, the man also showed "little remorse and accountability for his actions", the prosecutors said.
In his submissions, he accused the woman of having given him "come on" signs, which he took to mean consent.
He also referred to her photos on Facebook, which he claimed "showed cleavage".
"Only very 'loose' and sexually active women would do that, looking for adventures and one-night stands," he asserted.
The man also claimed that she had seduced him and plotted to frame him and alleged that she had orchestrated the affair to extort money from his family.
The prosecution asked for an increase in his sentence because of these claims, which they said were made "audaciously and without evidence".
However, the judge said he was entitled to raise them as part of his defence, according to CNA.
Used ChatGPT
The man used ChatGPT to search for cases to argue for the length of his sentence.
When the judge found out, she informed him that the legal cases he referred to did not exist and that ChatGPT was not a legal research tool.
"Thank you, Your Honour. I stand educated," he replied.
The man was eventually sentenced to 19-and-a-half years in jail on Jan. 24.
He also said he would hire a lawyer to run his appeal, according to CNA.
