Man, 31, tries to gang rape drunk woman, 32, under Tuas Viaduct, fails, gets 9 years' jail & caning
He claimed he "succumbed to temptation" after he saw his friend rape the woman.
A 32-year-old woman on the last train of the East-West Line, heavily intoxicated, found herself taking the train all the way to the last few stations in Tuas.
Two foreign workers decided to approach her but found her incoherent and did not respond to her questions.
At Tuas West Road station, they took her off the train, out of the station and to a grass patch under Tuas Viaduct.
They wanted to rape her.
What happened
The incident took place on Mar. 8, 2022, between 12:30am and 2:20am.
A passerby found the victim on his way to work and called the police.
She was curled up on the ground, partially undressed and bleeding from the head.
The workers, Alam Foysal, 38, and Ahmed Rayhan, 31, both Bangladeshi nationals, were arrested the next day and charged over the case.
Rayhan pleaded guilty to a charge of attempted rape, while Foysal's case is still pending.
According to The Straits Times and Shin Min Daily News, Rayhan claimed he didn't rape the woman but saw Foysal doing so.
Rayhan claimed he tried but couldn't do it.
Had drinks before going back to their dorm & found drunk victim
Both men worked as welders on the same construction-related project and stayed in the same dormitory.
The duo met a mutual friend for drinks and decided to take the last train back to their dormitory at Chinese Garden MRT station.
The victim was in the train carriage next to theirs. She was heavily intoxicated and behaving erratically.
In her drunken stupor, she walked up and down the aisle, sat on the floor and stood up.
The two men approached her and tried to strike up a conversation, but she was too drunk to be conversed with.
Told station staff they were taking her home
The men decided to take the victim with them as the train arrived at Tuas West Road station.
Foysal supported the victim and guided her out of the train carriage.
The victim caused a commotion as she struggled to tap out of the gantry and attracted the attention of the station staff.
Foysal told them that he and Rayhan had met the victim on the train and were taking her home as she lives nearby.
Foysal held her wrist and led her to a grass field underneath Tuas Viaduct, near the station.
Said friend raped victim
After they set the victim down on the ground, Rayhan claimed it was then he realised that his friend wanted to "have sex" with the victim.
Rayhan molested and sexually violated the woman while Foysal unzipped his pants.
Rayhan said he saw Foysal rape the victim, and he wanted to rape her too.
However, after a few failed attempts, he gave up.
Foysal then raped the woman a second time.
The two men then took a taxi back to their dormitory and left the victim in the field.
"Made the biggest mistake of his life": defence
The prosecutor sought eight to 10 years in jail and six strokes of the cane for Rayhan.
They said Rayhan knew the victim did not have the capacity to consent to sexual acts. He took advantage of her while she was in a vulnerable state, they added.
Rayhan's lawyer, Mahadevan Lukshumayeh, said his client "made the biggest mistake of his life", ST reported.
Rayhan "succumbed to temptation" upon seeing his friend violate the victim, the lawyer said.
Rayhan was sentenced to nine years in jail and nine strokes of the cane on Oct. 18 after pleading guilty to a charge of attempted rape.
Two other charges were taken into consideration – one for sexual assault by penetration and one for outrage of modesty.
