A 36-year-old man has been sentenced to 10 years' jail and six strokes of the cane after having sex with his employer's underage stepdaughter.

According to The Straits Times, the man — who is a father of six — exchanged text messages with the girl, who was 11 at the time, before having sex with her in the back of a delivery van that was assigned to him for work.

Neither party was named in order to protect the identity of the victim, now 13 years old.

How the affair started

The High Court heard on July 17 that the accused first met the victim when her family moved into his neighbourhood in July 2017.

Their families subsequently grew close and visited each other's homes regularly.

In early 2018, the accused was then hired by the stepfather of the girl to work as an operations manager in his transport company.

By March 16, 2018, the girl, who had been exchanging text messages with the man over WhatApp, confessed that she liked him while acknowledging that he was married. She also asked if her age was a concern.

The accused responded that men could have four wives, and that "age (was) just a number".

ST reported that he had called her "darling" in their correspondence and that they had sent each other pornographic videos.

Sex in the back of his work van

On the afternoon of May 10, 2018, the girl went to his flat on his suggestion, when the rest of his family was not home.

Once there, the accused proceeded to touch her sexually on his bed, before she had to leave, so that he could pick up his wife and children.

He then picked her up in his van five days later on May 15.

The accused asked the girl to sit on a sofa that had been placed at the back of the van and parked it in a nearby multi-storey car park.

He then had unprotected sex with her on the sofa.

How he was discovered

The man was arrested on June 11 after the girl confessed to her parents that she had engaged in sexual acts with the accused.

They had been questioning her after growing suspicious of her communication with him.

The man admitted what he had done after being confronted by the stepfather, who then called the police.

Once arrested, the man told police that the sexual acts were "for fun".

He also said that he had wanted to "entertain and let her experience the sexual acts".

"Should have known better"

In court, the man's defence lawyer Mohamed Fazal Abdul Hamid pointed out that it had not been "one-way traffic" between the accused and the girl.

He also said that the man had not expressly told the girl to keep their affair a secret.

Deputy Public Prosecutor Kavita Uthrapathy countered by saying that the girl would not have appreciated or understood the implications of the affair, while pointing out that the accused, being an adult "should have known better than to engage in sexual activity with an underage girl".

The accused pleaded guilty to a charge of statutory rape and was sentenced to 10 years' jail and six strokes of the cane.

In sentencing, three other charges were taken into consideration.

They were for committing an indecent act with a child, sexual assault by penetration, and possessing obscene films.
